Overview
We work for the inclusion of the notions of ecology and solidarity in the French Constitution. We want to write the first ecological Constitution in French history and thus reconcile nature and politics. In domestic law, the Constitution is the source of law at the top of the hierarchy of norms theorised by Joseph Kelsen: it implies that all laws, legal measures, decrees, decisions and regulations must comply with the Constitution. The importance of the inclusion of ecology and solidarity in the Constitution is therefore decisive. More than a symbolic and political step forward, it is also a necessary step towards the ecological transition and the change of mentality we must adopt in the face of climate emergency!
Objectives
- Includingplanetary boundaries in the Constitution: the planet and all living beings must be preserved. Let’s not take more resources than the planet can give us.
- Enshriningthe principle of non-regression in the Constitution: In the face of emergency, it is necessary to always do better for environmental protection and the fight against climate change.
- Having an ambitious reform of the Economic Social and Environmental Council: For an acknowledgement of the long-run sustainable challenges and citizen action.
How ?
In partnership with REFEDD, WARN! and CliMates, Notre Affaire à Tous launched the Call for an Ecological Constitution, signed by about 100,000 people! The petition calls for the inclusion of, inter alia, the preservation of our climate and biodiversity, planetary boundaries as well as the non-regression principle in the Constitution.
The Citizen’s Climate Convention,composed of 150 randomly selected citizens whose objective is to define measures to reduce France’s greenhouse gas emissions by at least 40% by 2030, in a spirit of social justice, was an opportunity to continue this action. As soon as it was launched in October 2019, we brought our demands for an Ecological Constitution to see them included in the proposals of the 150, which the President of the Republic had pledged to faithfully carry.

Climate Witness Mapping

Convinced that the law can be a lever for citizen mobilization, the Affaire du Siècle has launcheda mapping of the impacts of climate change in France in order to build and sustain a community of citizens affected by climate change. The objective is to alert the public authorities on the seriousness of the situation and the concrete consequences for the French people of its climate inaction, and especially that it acts.

State inaction is illegal ! The state is obliged to respect its national, European and international commitments and to protect its citizens’ human rights. However, France is far from reaching its greenhouse gas emission reduction targets. This is why we are suing the state for climate inaction.
